Terms of Use

Effective date: October 23, 2026

Welcome to PhotoLife. These Terms of Use (the “Terms”) are a contract between you and the operator of PhotoLife that covers your use of the PhotoLife app and website (together, the “Service”). Please read them carefully before you use the Service. In these Terms, “we”, “us” and “our” mean the operator of PhotoLife, and “you” means the person using the Service. If the Chinese and English versions differ, the Chinese version prevails.

These Terms, together with our Privacy Policy, form the entire agreement between you and us. How we collect, use and protect personal data, and the rights you have under Taiwan’s Personal Data Protection Act, are governed by the Privacy Policy. These Terms do not repeat it and do not limit any of your personal data rights.

1. Operator

2. Review and Acceptance

  1. These Terms are always publicly available at https://photolife.app/en/terms. You can take as much time as you need to read them before you download the app, create an account or buy a membership. Under Article 11-1 of Taiwan’s Consumer Protection Act, you are entitled to a reasonable review period, and we will never ask you to give up this right.
  2. By creating an account (including a guest account) or starting to use the Service, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the Service.
  3. If anything in these Terms is unclear, it will be interpreted in your favor, as required by Article 11(2) of the Consumer Protection Act.

3. The Service

  1. The Service is a habit-building app. Its main features include logging daily activities, taking or choosing photos to hang on a “memory tree”, a journal, a schedule with reminders, an Unplug timer for time away from your phone (with background music), doodles and stickers, and sharing trees and cheers with tree friends. The exact features available are those the app offers at the time.
  2. To use the Service, you need a compatible iOS or Android device and an internet connection (some features work offline and sync to the cloud once you are back online). Minimum system requirements are shown on the App Store / Google Play listing.
  3. The Service is a tool for keeping a personal log and managing yourself. It does not provide medical, psychological or any other professional advice, and we do not guarantee that using it will help you build a particular habit or bring any particular physical or mental benefit. The Unplug timer relies on your own self-discipline and cannot block you from using other apps.
  4. Apart from tree friends (people you invite yourself, where you both agree to be tree friends; see Section 7.6), other users cannot see your content, and the Service has no public social features. If you use your phone’s built-in share feature to share a screenshot, you are responsible for how it spreads after you share it.

4. Changes to the Service

  1. We may add, change or remove features to improve the Service, fix problems, or comply with laws or third-party platform rules.
  2. If a change significantly reduces the features that paying members have paid for, we will notify you at least 30 days in advance as described in Section 18. You can cancel your subscription before the change takes effect and request a refund for the period you have paid for but not used, under Section 9.
  3. We will announce ordinary changes to free features in the app or on the website.

5. Age and Minors

  1. The Service is not directed to children under 13. If you are under 13, please do not use the Service.
  2. Under Articles 12, 77 and 79 of Taiwan’s Civil Code, if you are under 18, you may use the Service only after your legal guardian (usually a parent) has read, understood and agreed to these Terms. The same applies whenever these Terms are amended. Minors must also get their legal guardian’s consent before buying a membership.
  3. If a minor buys a membership without their legal guardian’s consent, the guardian can email us, and we will handle it under Section 9.4.
  4. A legal guardian who consents to a minor using the Service is treated as agreeing to all of these Terms and is responsible for supervising the minor.

6. Accounts

  1. Sign-in methods: You can sign in with email, Apple or Google, or choose “Continue as Guest” to create a guest account.
  2. Accurate information: When you sign up, please give a correct email address so you can receive account confirmations, password resets and important notices. If your email is wrong or can’t receive mail, you may be unable to recover your account or receive notices.
  3. Keeping your account secure: You are responsible for keeping your account, your password and the Apple / Google account you sign in with secure. Do not give them to anyone else or share them with others. If you find out that someone else is using your account without your permission, email us right away. Once we confirm it, we will first suspend the account, help you secure it again (for example, by resetting your password), and then let you use it again. You are responsible for any losses caused by not keeping your account secure, except to the extent the loss is attributable to us.
  4. Guest account risk (please read carefully): A guest account is not linked to an email or any other sign-in method. Once you sign out, delete the app or switch phones, its data cannot be recovered, and we cannot restore it for you. To keep your records long term, sign in with email, Apple or Google instead.
  5. One person, one account: Your account is for your own use only. You may not lend, transfer, sell or pass it on to anyone, including by inheritance (except for paid benefits that can be inherited by law).
  6. Deleting your account: You can delete your account at any time in the app, or request deletion as described in How to delete your account. Guest accounts have no email we can use to verify your identity, so they must be deleted in the app. After deletion, your data is handled as described in the Privacy Policy and cannot be restored. Deleting your account does not automatically cancel an Apple or Google subscription. Cancel it separately as described in Section 8.4.

7. Your Content

  1. You own your content: The copyright and other rights in the photos, journal entries, plans, doodles and other content you upload or create in the Service (“Your Content”) belong to you or the original rights holder. We do not take ownership of Your Content.
  2. The limited license we need: So that we can provide the Service to you, you grant us a worldwide, royalty-free, non-exclusive license to use Your Content only to: store it, back it up, sync and display it across your devices, resize or compress files for uploading and display, fix technical problems, and respond to your support requests. We will not make Your Content public, sell it, give it to advertisers, or use it for any other purpose (including as marketing material).
  3. When the license ends: The license ends when you delete the content in question or your account. However, it continues for the reasonable time we need to complete deletion under the Privacy Policy, and for anything the law requires us to keep.
  4. Your promise: You promise that you have the right to upload Your Content and that it does not infringe anyone’s copyright, portrait rights, privacy or other rights. Please get people’s consent before you take or upload photos of them.
  5. If a third party claims that Your Content infringes their rights and provides specific evidence, we may temporarily stop displaying or remove that content to the extent necessary, and we will notify you so you can respond.
  6. Tree friends: Tree friends you invite or accept (up to 5) can see the photos on your current tree (see the Privacy Policy for exactly what they can see). Please don’t put photos on your tree that you wouldn’t want your tree friends to see, and respect anyone who appears in your photos. Tree friends can cheer on the activities the other has completed that day (with a set sticker, a line of up to 100 characters, or both, with no links), and the system blocks inappropriate words before a cheer is sent. You can delete or report any cheer you receive (a reported cheer is hidden right away). You can also “Remove” or “Report” a tree friend from your tree friends list at any time (once removed, they immediately lose access to your tree). We review reports within 24 hours of receiving them and, if necessary, take action under Section 13.

8. Membership Subscription

This section applies once memberships officially become available. Until then, all features of the Service are provided free of charge.

  1. Membership: The basic features of the Service are free. A paid membership unlocks all memory trees and Season 2, Workout and Travel journals, the doodle wall and other features, as described on the purchase page. Once memberships become available, the price is NT$100 per month (the amount shown on the App Store or Google Play purchase page applies).
  2. Payment: Memberships can only be bought through in-app purchase on the Apple App Store or Google Play. Apple or Google processes the payment under its own payment terms. We never receive your credit card or payment account details (see Section 5 of the Privacy Policy).
  3. Auto-renewal: Memberships renew automatically every month. Unless you cancel at least 24 hours before the end of the current period, you will automatically be charged the price at that time for the next period when the current one ends, and your membership will be extended by one month.
  4. How to cancel:
    • iPhone / iPad: Settings → tap your name → Subscriptions → PhotoLife → Cancel Subscription.
    • Android: Google Play → Payments & subscriptions → Subscriptions → PhotoLife → Cancel subscription.
    After you cancel, you can keep using member features until the end of the current period, and you will not be charged again. Deleting the app or your account does not cancel your subscription.
  5. Restore purchases: If you switch phones or reinstall the app, tap “Restore Purchases” on the membership page in the app to get your membership back.
  6. Price changes: If we change the membership price, we will notify you at least 30 days before the change takes effect, as described in Section 18 (in-app announcement and email), and we will follow Apple’s or Google’s rules (where those rules require your consent, we will not charge you the new price without it). The period you have already paid for is not affected. If you do not accept the new price, you can cancel before it takes effect.
  7. Free trials and offers: If we offer a free trial or a discount, the purchase page will clearly state how long the trial lasts, the price after the trial, and when you will be charged. If you do not cancel before the trial ends, it will automatically turn into a paid subscription.

9. Seven-Day Refund and Other Refunds

  1. Seven-day refund, no questions asked: Under Article 19 of the Consumer Protection Act, within 7 days after you first subscribe (or subscribe again after cancelling), you can cancel the contract without giving a reason and get a full refund of the amount you paid for that purchase. See Section 9.3 for how to request it. If the platform does not accept your request, email us and we will handle it under Section 9.4.
  2. For later auto-renewal periods, you can cancel at any time. Your membership stays active until the end of the current period, and we do not give daily prorated refunds (except in the cases listed in Section 9.4). This section does not affect any other rights you have by law. If member features are defective or unusable for reasons attributable to us, you can still exercise your legal rights.
  3. How to get a refund: Because Apple or Google collects the payment, refunds are generally handled under that platform’s rules and process:
    • Apple: request a refund at https://reportaproblem.apple.com. Apple reviews the request.
    • Google Play: within 48 hours of purchase, you can request a refund directly from Google Play. After 48 hours, email us and we will handle it under Google Play’s rules and applicable law.
  4. When we help with refunds: In the following cases, email us. We will first help you request a refund from Apple or Google. If the platform does not accept the request, we will refund the paid but unused part of your membership on a prorated basis, by a method we both agree on (items (4) and (5) are handled as stated in those items):
    • (1) we significantly reduce member features under Section 4.2, and you cancel your subscription before the change takes effect;
    • (2) we discontinue the Service under Section 14;
    • (3) we ended this agreement with you based on a mistaken finding of fact, as described in Section 13.5;
    • (4) a minor made a purchase without their legal guardian’s consent (see Section 5.3): we handle it under the Civil Code and Apple’s / Google’s rules, with a full refund if necessary;
    • (5) you cancel within 7 days after you first subscribe or subscribe again under Section 9.1, and the platform does not accept your refund request: we refund the full amount you paid for that purchase;
    • (6) you end this agreement by objecting to an amendment under Section 18.2;
    • (7) any other case where the law requires a refund.
    If we need to refund you directly, we will ask for the account details where you want to receive the refund (used only for the refund), and we will complete the refund within 30 days after confirming those account details.

10. Prohibited Conduct

When using the Service, you must not:

  1. Upload or store unlawful content, including child sexual exploitation material, intimate images of others without their consent, or content that infringes copyright or other rights.
  2. Reverse engineer, decompile, disassemble, crack or modify the app or servers, or try to get the source code (except where the law expressly allows it).
  3. Get around or crack the membership payment system, access controls or security measures, or try to access data that isn’t yours.
  4. Use bots, crawlers, scripts or other automated means to access, scrape or perform large numbers of actions on the Service.
  5. Create large numbers of guest or other accounts, upload huge amounts of data, or otherwise abuse storage space or system resources.
  6. Spread viruses or malicious code, or attack, interfere with or overload the system.
  7. Extract, resell, rent, redistribute or commercially use the Service or any of its illustrations, music, artwork or other assets.
  8. Pretend to be someone else, or buy a membership by fraud or other improper means.
  9. Use the tree friends feature (including the text of cheers) to harass, threaten, insult or offend others, send sexual or promotional content, or copy or spread a tree friend’s photos for other uses.
  10. Do anything else that violates the laws of the Republic of China (Taiwan).

11. Intellectual Property

  1. The copyrights, trademarks and other intellectual property rights in the Service’s software, interface design, memory trees, illustrations, icons, tree artwork, logos, text, background music and other assets (excluding Your Content) belong to us or to rights holders who have licensed them to us.
  2. We give you a personal, non-exclusive, non-transferable, non-sublicensable right to use the Service on devices you own or control, for non-commercial purposes, under these Terms and the App Store / Google Play usage rules. We will revoke this right only if this agreement is terminated under Section 13. You receive no other rights.
  3. We made the background music in the app ourselves, and we license it to you only for playback within the Service. You may not record, extract or redistribute it.
  4. We may freely use any feedback or suggestions you give us to improve the Service, without paying you for them. However, we will not reveal your identity or Your Content because of this.

12. Service Interruptions and Backups

  1. Planned maintenance: If we plan maintenance that we expect will interrupt core features for more than 4 hours, we will post a notice on the website 7 days in advance. This does not apply to temporary or urgent situations, or to situations not attributable to us (for example, cloud provider outages, natural disasters or network failures). In those cases, we will fix the problem as soon as possible.
  2. System security: We will make reasonable efforts to keep our systems as secure as can reasonably be expected with the technology available at the time. If our systems are unlawfully accessed or damaged, we will take reasonable steps to restore them as soon as possible and will be liable as provided by law.
  3. Keep your originals (important): To save space and speed up syncing, photos uploaded to the cloud are resized and compressed (to about 1280 pixels on the long side, not original quality). The Service is not a photo backup tool. Please keep your own backups of your original photos and important journal entries.
  4. Offline data: Records you create without an internet connection are stored on your phone first and uploaded once you are back online. If you delete the app, switch phones or your phone breaks before they are uploaded, that data may be lost.
  5. Reminders are scheduled on your phone and may not appear on time because of phone settings, battery-saving modes or system limits. Please do not rely on them as your only reminder.

13. Suspension and Termination

  1. You can end this agreement at any time: You can stop using the Service or delete your account at any time (see Section 6.6).
  2. Ordinary violations: If you violate these Terms, we will first tell you what the violation is by email or in-app notice and ask you to fix it within a reasonable time. If you do not fix it, we may suspend some or all features or terminate this agreement, depending on how serious the violation is.
  3. Serious violations: In any of the following cases, we may suspend your account or terminate this agreement immediately after notifying you:
    • violations of Section 10, item 1 (unlawful content), item 3 (cracking or accessing others’ data), item 6 (attacking the system) or item 8 (impersonation or fraudulent purchase);
    • repeating the same type of violation 3 or more times after being asked to fix it;
    • a lawful request from a court or the relevant authorities.
    Guest accounts have no email, so we will notify guest users in the app.
  4. Appeals: If you disagree with a suspension or termination, you can appeal by emailing support@photolife.app within 7 days, counting from the day after you receive the notice. We will reply with the outcome within 15 days of receiving your appeal.
  5. Mistakes: If our finding of a violation is mistaken or we cannot prove it, we will restore your account and compensate you for your damages as provided by law.
  6. Data after termination: If we discontinue the Service under Section 14, or if we terminate this agreement for any reason other than those in Section 13.3, we will keep your account data for at least 30 days after termination, and you can request a copy of your data during that time. If you delete your account yourself, Section 6.6 and the Privacy Policy apply.
  7. We will not terminate this agreement without a valid reason.

14. Discontinuation of the Service

If we decide to discontinue the Service, we will announce it on the website and notify you as described in Section 18 (in-app announcement and email) at least 30 days before the end date, and we will stop accepting new subscriptions at the same time. We will refund any membership time you have paid for but not yet used after the end date, under Section 9.4. Before the Service ends, you can request a copy of your data under the Privacy Policy.

15. Liability and Limitation of Liability

  1. We will use reasonable care in providing the Service, but the Service is provided as is. We cannot guarantee that it will never be interrupted, will be free of errors, or will meet your particular needs.
  2. To the extent the law allows, for damage caused by our slight negligence, our total liability is limited to the total membership fees you actually paid for the Service in the 12 months before the damage occurred. If you have not paid anything, or that total is less than NT$1,000, the limit is NT$1,000.
  3. The limit above does not apply to: (1) our intentional misconduct or gross negligence (Article 222 of the Civil Code); (2) harm to life, body or health; (3) liability that cannot be reduced or excluded under the Consumer Protection Act or other laws; (4) our system security obligation in Section 12.2, mistaken findings under Section 13.5, and our liability under the Personal Data Protection Act.
  4. We are not liable for the following, except to the extent attributable to us: your failure to keep your account and password secure; guest account data that cannot be recovered after you sign out; your failure to keep your own originals as described in Section 12; problems with your device or network; failures of the third-party services themselves (see Section 16); and force majeure events such as natural disasters, war or government orders.
  5. If your breach of these Terms or your infringement of a third party’s rights leads a third party to make a claim against us or causes us damage, you are responsible for dealing with it and must compensate us for the resulting damage (including reasonable costs we can recover by law), except to the extent attributable to us.

16. Third-Party Services

  1. The Service uses services provided by third parties, including Apple and Google (sign-in, app stores and payments), Supabase (accounts, database and photo storage, with servers in Tokyo, Japan), Resend (sending system emails), Cloudflare (the website, the support mailbox, the human check at sign-in, and daily backups), GitHub (running the daily backup job), Expo (delivering app updates), and possibly RevenueCat in the future (managing subscription status). The Privacy Policy explains how these services handle data.
  2. When you sign in or pay with Apple or Google, you must also follow that company’s terms of service. Outages or policy changes at third-party services may affect some features of the Service. We will do our best to respond and keep you informed.

17. Additional Terms for Apple App Store Downloads

If you downloaded the app from the Apple App Store, the following also applies:

  1. These Terms are concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for the app and its content.
  2. Your license is a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the app may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
  3. We are solely responsible for providing maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
  4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility, subject to Section 15 of these Terms.
  5. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including: (1) product liability claims; (2) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (3) claims arising under consumer protection, privacy or similar legislation.
  6. In the event of any third-party claim that the app or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  7. You represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Questions, complaints or claims about the app should be directed to us using the contact details in Section 1.
  9. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
  10. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. Changes to These Terms

  1. We may amend these Terms because of changes to the Service, the law or third-party platform rules. When we do, we will post the amended Terms and their effective date on the website and notify you through an in-app announcement and by email (if we have yours). Guest accounts without an email will be notified through an in-app announcement. An amendment has no effect unless we have both posted it and notified you.
  2. Amendments generally take effect 15 days after we notify you (except for amendments the law requires to take effect immediately, which we will still post and notify you about). If you do not object within 15 days of the notice and keep using the Service, you are treated as accepting the amendment. If you object, your objection is treated as notice that you are ending this agreement. You can then delete your account and cancel your subscription, and any period you have paid for but not used will be handled under Section 9.4.
  3. Changes to the membership price follow Section 8.6 instead (at least 30 days’ notice).

19. Support and Disputes

  1. If you have questions, complaints or a consumer dispute, email support@photolife.app. We will reply within 15 days of receiving your email.
  2. Under Articles 43 and 44 of the Consumer Protection Act, you can also file a complaint with a consumer protection group or with the consumer service center of any special municipality, county or city government (consumer hotline 1950 in Taiwan). If your complaint is not properly resolved, you can apply for mediation with the consumer dispute mediation committee of the special municipality, county or city.

20. Governing Law and Jurisdiction

  1. These Terms are governed by and interpreted under the laws of the Republic of China (Taiwan).
  2. If a lawsuit arises from these Terms or the Service, both parties agree that the Taiwan Tainan District Court will be the court of first instance. However, this does not exclude the application of Article 47 of the Consumer Protection Act (the court where the consumer relationship arose), or Articles 28(2) and 436-9 of the Code of Civil Procedure.
  3. If you live outside the Republic of China (Taiwan), this section does not affect any consumer rights you have under your local law that cannot be waived by contract.

21. Miscellaneous

  1. Severability: Except in the cases described in the proviso of Article 16 of the Consumer Protection Act, if any part of these Terms is invalid under the law, the rest remains in effect.
  2. Individual agreements prevail: If a separate agreement that you and we have negotiated individually conflicts with these Terms, that individual agreement prevails.
  3. No waiver: If we do not exercise a right under these Terms at some point, that does not mean we give up that right.
  4. Language: These Terms are available in Chinese and English. If the two versions are inconsistent, the Chinese version prevails.
  5. Notices: We will send notices to the email you registered or post them as in-app announcements. Please send notices to us at support@photolife.app.
